Proposed Legislation to Strengthen the Health and Supportive Care Workforce During COVID-19 and Beyond

The Ontario government is taking action to build a more connected, patient-centred health care system through the introduction of a new bill, the Advancing Oversight and Planning in Ontario’s Health System Act, 2021.

Ontario Introduces Legislation to Strengthen Health Workforce Accountability and Enhance Data-Driven COVID-19 Response

Ontario government introduced legislation that, if passed, will help strengthen Ontario’s health care workforce and support the delivery of high-quality care by regulating personal support workers, physician assistants and behaviour analysts. This legislation would also enhance the province’s response to the COVID-19 pandemic by promoting the timely reporting of COVID-19 vaccine data to the Ministry of Health. The proposed legislation is part of the government’s commitment to build a more connected, patient-centred health care system.

Ontario Government PSW Regulation Short on Details Raises More Questions than Answers...

SEIU Healthcare, Unifor, and CUPE, unions representing 175,000 healthcare workers across Ontario, are concerned that the Ford government in Ontario has introduced a Bill to regulate personal support workers (PSWs) without also providing the urgent supports they need right now as they continue to fight the pandemic.

Proposed Changes would lead to the regulation of Personal Support Workers, Physician Assistants and Behaviour Analysts in the Province of Ontario

On April 27, 2021 Ontario introduced Bill 283, Advancing Oversight and Planning in Ontario’s Health System Act, 2021 (“Bill 283”). As of the date of this bulletin, Bill 283 passed its second reading and has been ordered referred to the Standing Committee on Social Policy.

Bill 283 is comprised of various parts, included among which are four Schedules:

Schedule 1 - Covid-19 Vaccination Reporting Act, 2021

Schedule 2 - Health and Supportive Care Providers Oversight Authority Act, 2021

Schedule 3 - Medicine Act, 1991

Schedule 4 - Psychology and Applied Behaviour Analysis Act, 2021

Unlike professionals regulated by Colleges under the Regulated Health Professions Act, the Bill does not prevent non-registered PSWs from working as PSWs.

BILL 283 Regarding PSWs

Bill 283 establishes a corporation called the “Health and Supportive Care Providers Oversight Authority” (the “Authority” (s. 2), governed by a board of 8-12 directors (s. 4(2)). The qualifications for sitting on the Board will be determined by regulation and the Authority’s by-laws (s. 4(6)). The Board will appoint one of its employees to be the Chief Executive Officer (s. 10(1)). The Statutory Powers Procedure Act does not apply to anything done by the CEO, except as may be provided in regulation (s. 10(4)).

Unlike professionals regulated by Colleges under the Regulated Health Professions Act, the Bill does not prevent non-registered PSWs from working as PSWs. However, non-registrants are not permitted to use the visual mark or other identifier established by the Authority or to hold themselves out as a registrant (s. 37).
